TRENTON, NJ — New Jersey Attorney General Matthew J. Platkin has announced that the state is joining a coalition of 11 other attorneys general in a significant legal battle against the federal government. This lawsuit aims to challenge the government’s recent efforts to invalidate state vehicle emissions standards by employing the Congressional Review Act (CRA), a legislative tool that allows Congress to disapprove federal regulations. The crux of this legal action centers on the federal government’s attempt to dismantle California’s Advanced Clean Cars II (ACCII), Omnibus, and Advanced Clean Trucks (ACT) standards. These regulations, which New Jersey adopted in 2023 and 2021, play a crucial role in addressing environmental concerns. They require automotive manufacturers to progressively sell increasing numbers of zero-emission vehicles while imposing strict limits on nitrogen oxide emissions, particularly from heavy-duty trucks that significantly contribute to air pollution.
